In May, the low-cost airline Pobeda (part of the Aeroflot group) went to the Supreme Court with a demand to declare illegal the rules for the carriage of hand luggage for non-refundable so-called bagless air tickets, by order of the Ministry of Transport in November 2017.

The Ministry of Transport and the Ministry of Justice were the defendants in the case.

Under the new rules, airlines can sell tickets at no-baggage fares (previously there was a mandatory free rate of 10 kg), but a passenger can take with him a free hand luggage weighing 5 kg. However, in addition to this, according to clause 135 of the Federal Aviation Rules, airlines are obliged to take a set of items from the approved list free of charge. It includes: a backpack, the weight and dimensions of which are established by the carrier's rules, a handbag, a bouquet of flowers, outerwear, a suit in a garment bag, baby food for the child during the flight. In addition, the list includes drugs, crutches, canes, walkers, duty-free goods packed in a sealed plastic bag, the weight and dimensions of which are established by the carrier's rules, etc.

However, Pobeda opposed this approach. The carrier believes that, by its order, the Ministry of Transport imposed on the airlines mutually exclusive obligations: to accept carry-on baggage for transportation, the weight and dimensions of which ensure its safe placement in the aircraft cabin (clause 133 of FAP-82), and the obligation to accept things for transportation as carry-on baggage without taking into account their weight, dimensions and the possibility of safe placement in the aircraft cabin, with the exception of a backpack (paragraph 135 of FAP-82).

The general director of "Pobeda" Andrey Kalmykov in the courtroom demonstrated things that, according to paragraph 135 of the FAP, are obligatory for transportation by the airline: a suitcase, a woman's bag, a backpack, a bouquet of flowers, outerwear. As a result, we got a whole bunch of things allowed for free for transportation. At the same time, Kalmykov stressed that the obligation to transport these things threatens the safety of the flight. “We do not mind baby food, as well as social items such as crutches and the like, we will find a place in the salon for this,” he said. Kalmykov added that the law does not contain the concept of "women's bag". “For some, a woman’s bag is a huge checkered shuttle bag,” he said.

The representative of the Ministry of Transport suggested "not to bring to the point of absurdity" the topic with things from the list of FAP 135. He added that this list will be adjusted to eliminate contradictions.

The Ministry of Justice sided with the Ministry of Transport regarding the transportation of hand luggage. A spokesman for the Ministry of Justice also added that the “over-the-limit” rate may be adjusted in the future.

When asked by the prosecutor about the basis of which the airline concluded that the items shown threaten safety, Kalmykov explained that they had consulted the manufacturer of Boeing aircraft used by Pobeda. “We turned to the manufacturer, and we received an answer that for 189 people (the number of passengers on the Pobeda liners. - RBK) it is possible to place only carry-on baggage that corresponds to the calibrator, ”he noted.

In December, the carrier is already on the new baggage rules in the Ministry of Transport. According to the general director of the airline, Andrey Kalmykov, the ministry should not impose service requirements on airlines; only safety requirements should be spelled out in the rules. At the same time, Pobeda has its own rules since December 10, prohibiting passengers from taking with them into the aircraft cabin things that exceed the size of the airline's standard for free hand luggage 36x30x27 cm, even for an additional fee. The change in the rules in the airline was explained by the lack of space for extra baggage in the aircraft cabins.

The Russian low-cost airline continues to attract with tickets for 499 rubles. But experienced traveler first, he will clarify what is included in this price and what the requirements for baggage are. So, there are three main rules for free baggage transportation on Pobeda:

Transportation of animals

Airline "Pobeda" allows the carriage of animals for a fee. The fact that you are going to take a pet or a bird with you on the flight must be declared to the airline representative at the stage of booking a ticket, but no later than 24 hours before departure. After all, no more than four animals are allowed to be transported on one flight. Each container with an animal must be placed at least four rows from the other. For a pet transported in a container, you will have to pay 1999 rubles. Animals are not transported in the luggage compartment by low-cost airlines. The pet must be wearing a collar with a home address. Before departure, you should feed him well and walk him.

Employees of the canine services of federal executive bodies may transport service dogs in the aircraft cabin with the consent of the air carrier. In this case, the dog must be wearing a muzzle and must be tied to the passenger seat.

Pobeda Airlines has published the next version of its rules for the carriage of baggage and hand luggage. They, in particular, contain extremely strange and restricting passenger rights provisions that are in conflict with the Federal Aviation Regulations.

Meanwhile, even the new version of the Federal Aviation Regulations (FAP-82), the adoption of which, by its own admission, was so sought by Aeroflot in the interests of Victory, contains a requirement to carry all absolutely free items in excess of the carry-on baggage allowance established by the airline. That is, FAPs do not allow the airline to require that these items comply with any of its standards, fit into any calibrators, and the like.

Pobeda does not explain this collision in any way, but the explanation may be contained in the history of this airline. Recall that at the beginning of 2016, Pobeda suddenly began to demand that the aforementioned free items fit into 115 centimeters in the sum of three dimensions, although the FAP forbade setting such restrictions. Pobeda lost the lawsuit on this issue, but during the year it continued to challenge the verdict in three more courts. Only after yielding in May 2017 in the Supreme Court, Pobeda brought the rules in line with the law - but we do not know the facts of the return to passengers Money received by the airline for more than a year of obvious FAP violations.

The absurdity of Pobeda's demands will become even more vivid if we remember that some items from the absolutely free FAP list in general, by their very nature, cannot fit into Pobeda's calibrator box. This is primarily outerwear and a suitcase, the vast majority of portfolios available on the market, as well as almost all items required by a passenger for medical reasons (try placing a cane in a calibrator, you will be pleasantly surprised).

The thesis of "Victory" that its requirements are caused by the need to "safely place" carry-on luggage in the cabin is refuted by the carrier himself. For 1499-2000 rubles, this company is easily ready to allow the transportation of larger items with an amount of 115 centimeters in size, and the issue of "safe placement" when paying this amount is immediately removed.

In a word, the entry into force of the new FAP, which sharply restricts the rights of passengers in comparison with their previous version, does not at all mean the end of disputes and problems with hand luggage. On the contrary, Pobeda passengers will face even more severe pressure from the carrier. Those who are ready to fly with this company need to be ready for long debates with representatives of Pobeda on the compliance of its FAP rules, and, possibly, for litigation with the carrier following the results of each flight.

In any case, all Pobeda passengers wishing to exercise their right to transport unconditionally free items should have a copy of FAP-82 in their pockets on any flight by this company. It is worth remembering that disputes with representatives of the company at the check-in counter and at the boarding gate may not be limited - flight attendants can also make claims to hand luggage at Pobeda.
